1. Agreement to Terms

By accessing or using the Pragmabits platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Pragmabits ("we," "our," or "us").

2. Account Terms

To use certain features of the Service, you must create an account. By creating an account, you agree to the following:

• You must be at least 16 years old to create an account
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You may not create multiple accounts to circumvent plan limitations or for abusive purposes

3. Service Description

Pragmabits provides an AI-powered search agent platform that allows users to configure intelligent agents across multiple domains (jobs, deals, products, stocks, real estate, business, and news). Agents continuously scan, score, and deliver results based on user-defined criteria. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Subscriptions and Payments

Access to the Service is provided through subscription plans. By subscribing, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends
• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time. Access continues until the end of the current billing period
• Payments are non-refundable except where required by applicable law or at our sole discretion
• We may change subscription prices with 30 days' advance notice. Continued use after a price change constitutes acceptance

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal API usage
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Resell, redistribute, or sublicense access to the Service without our written consent

6. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by Pragmabits and protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent. Nothing in these Terms grants you any right to use our branding, logos, or other proprietary materials.

7. User Content

You retain ownership of any content you submit to the Service, including search criteria, agent configurations, and feedback. By submitting content, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing and improving the Service. We will not share your search criteria or agent configurations with other users or third parties.

8. Third-Party Services

The Service may integrate with or contain links to third-party services (such as Google OAuth for authentication and Lemon Squeezy for payment processing). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SEARCH RESULTS AND AI SCORES ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR ANY DECISION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAGMABITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pragmabits and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pragmabits is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
